These Terms of Service ("Terms") are a binding agreement between you and Rovymi Health ("Rovymi", "we", "us"). Please read them carefully, especially Section 18 (arbitration and class-action waiver), which affects how disputes are resolved.

1.Accepting these Terms
By visiting rovymi.com, starting an intake, creating an account, buying a plan or a gift card, or otherwise using our services (together, the "Service"), you agree to these Terms, our Privacy Policy and the other policies linked from this page. If you do not agree, do not use the Service.
2.Definitions
- "Platform" means the website, intake, patient portal, messaging and related technology made available by Rovymi and its technology providers, including Telea.
- "Medical Group" means ZMD of CA, P.C. and the independent physicians, nurse practitioners and other licensed clinicians affiliated with it ("Clinicians").
- "Pharmacy" means the independent, state-licensed pharmacy that prepares and dispenses a prescription (currently Perfect RX for injections and Vios for dissolving tablets).
- "Medical Services" means clinical services provided by Clinicians. Medical Services are not provided by Rovymi.
3.Eligibility
You must be at least 18 years old, legally able to enter into contracts, physically located in a U.S. state where the Service is available when you use it, and using the Service for yourself. You may not use the Service on behalf of another person. You agree that all information you provide is accurate, current and complete.
4.Your account
You are responsible for keeping your login method (including one-time codes sent to your phone) secure, and for all activity under your account. Tell us immediately at care@rovymi.com if you believe your account has been accessed without permission. We may suspend or close accounts that are inaccurate, shared, used fraudulently or used in violation of these Terms.
5.Rovymi is not a medical provider
Rovymi is a health and wellness company that provides the Platform and administrative services. Rovymi does not practice medicine, nursing or pharmacy, does not employ or direct Clinicians in their medical judgment, and does not dispense medication. Medical Services are provided by the Medical Group, which is independently owned and operated. Prescriptions are filled by the Pharmacy.
Clinicians decide, in their sole professional judgment, whether any treatment is appropriate for you. We do not guarantee that you will be prescribed any medication, that a particular medication or dose will be available, or any particular result.
6.When a clinician-patient relationship starts
Completing an intake or browsing our content does not create a clinician-patient relationship. That relationship begins only when a Clinician reviews your information and accepts you as a patient, under the laws of your state. Some states require a live video or phone visit first; if so, we will tell you during the intake.
7.Subscriptions, fees and billing
Prices, what is included, billing frequency and renewal terms are shown before you pay. By purchasing a plan you authorize us and our payment processor (Stripe) to charge your payment method for the plan you select and, unless you cancel, for each renewal period at the then-current price, until you cancel.
Multi-month plans are billed in full at the start of the period. Medication on multi-month plans is generally shipped monthly. Prices may change; we will notify you before a price change applies to your next renewal, and you may cancel before it takes effect.
If a payment fails we may retry it, pause shipments, or suspend your plan until it is resolved.
8.Insurance and government programs
The Service is self-pay. We do not bill or accept insurance, Medicare, Medicaid, TRICARE or any other government health program, and amounts you pay may not count toward any deductible. Do not use the Service if you are required by law or contract to use a government program for these services. You may request a receipt to submit to an HSA or FSA administrator; eligibility is their decision.
9.Pharmacy and shipping
If a Clinician issues a prescription, it is sent to the Pharmacy, which is responsible for preparing, labeling and dispensing it. Compounded medications are prepared for you individually; they are not FDA-approved, and the FDA does not verify their safety, effectiveness or quality before they are dispensed.
You may ask for your prescription to be sent to a pharmacy of your choice where the law allows; pricing and availability may then differ. You are responsible for providing an accurate shipping address and for storing medication as instructed once delivered. Title and risk of loss pass to you on delivery.
10.Gift cards
Rovymi gift cards can be used toward Rovymi plans and services, have no fees, and are not redeemable for cash except where required by law. Lost or stolen gift cards can be replaced only if we can verify the purchase and the card has not been used. Gift cards are subject to these Terms and to verification for fraud.
11.Cancellation and refunds
You may cancel future renewals at any time from your patient portal or by emailing care@rovymi.com. Refunds are governed by our Refund Policy, which is part of these Terms.
12.Communications and electronic consent
You agree to receive communications from us, the Medical Group and the Pharmacy electronically, including by email, text message and in-portal message, about your account, care, orders, shipping, billing and service updates. Electronic records and signatures have the same effect as paper ones (E-SIGN Act).
Message and data rates may apply. You can opt out of marketing messages at any time by replying STOP or using the unsubscribe link; we will still send messages needed to provide the Service. Do not send health information by ordinary email.
13.Prohibited use
- Providing false, misleading or incomplete health or identity information, or obtaining medication for someone else.
- Reselling, sharing or transferring any medication you receive.
- Accessing or attempting to access accounts, systems or data you are not authorized to use; scraping, probing or overloading the Platform.
- Using the Service in violation of any law, or to harass, threaten or abuse our staff or Clinicians.
14.Intellectual property
The Platform and our content, names, logos, photography, video and design are owned by or licensed to Rovymi and protected by law. We grant you a limited, revocable, non-transferable license to use the Service for your personal, non-commercial use. Third-party trademarks, including brand-name medicines, belong to their owners and are mentioned only for identification.
15.Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE PLATFORM AND OUR CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ACCURACY. ROVYMI DOES NOT WARRANT ANY MEDICAL OUTCOME, AND IS NOT RESPONSIBLE FOR THE CLINICAL JUDGMENT OF CLINICIANS OR THE ACTS OF THE PHARMACY. NOTHING IN THESE TERMS LIMITS ANY WARRANTY OR RIGHT THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.
16.Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ROVYMI AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID ROVYMI IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR $100. SOME STATES DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.
17.Indemnification
You agree to defend, indemnify and hold harmless Rovymi and its owners, officers, employees, contractors and service providers from any claims, losses and expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Service, or your violation of any law or the rights of another person, including any inaccurate information you provide.
18.Mandatory arbitration and class-action waiver
PLEASE READ CAREFULLY. You and Rovymi agree that any dispute, claim or controversy arising out of or relating to these Terms or the Service ("Dispute") will be resolved by final, binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small-claims court, and either party may seek injunctive relief for infringement of intellectual property. The Federal Arbitration Act governs this section.
YOU AND ROVYMI WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE OR REPRESENTATIVE ACTION. The arbitrator may award relief only to the individual party seeking it. Before starting arbitration, the party with a Dispute must send a written notice describing it to the other (for Rovymi, to care@rovymi.com) and try in good faith to resolve it for 30 days.
You may opt out of this arbitration agreement by emailing care@rovymi.com with the subject "Arbitration opt-out" within 30 days of first accepting these Terms. Claims of medical malpractice against a Clinician are not governed by this section and are subject to applicable state law.
19.Governing law and venue
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules, except where the law of your state of residence requires otherwise. Subject to Section 18, any court proceeding will be brought in the state or federal courts located in Massachusetts, and you consent to their jurisdiction.
20.Complaints to state medical boards
You have the right to file a complaint about a Clinician with the medical or nursing board of the state where you received care. Contact details for state boards are available from the Federation of State Medical Boards at fsmb.org.
21.Changes to these Terms
We may update these Terms. If we make material changes we will post the new Terms with a new date and, where required, notify you. Changes apply from the date posted and do not apply retroactively to Disputes already noticed. Continuing to use the Service after the effective date means you accept the changes.
22.General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. These Terms, with the policies they reference, are the entire agreement between you and Rovymi about the Service.
